Lien Law 182 Amendment
This is an extremely important message concerning a change to the New York State Lien Law Section 182, the main law that governs our self-storage industry. A bill that amends the law in several ways for the benefit of both operators and occupants passed the NY State Assembly and Senate this past summer. The bill was sent to the Governor for signature on October 17th. The bill has now been signed by Governor Cuomo. That means the changes to the Lien Law are effective as of Tuesday, October 29, 2019. If you have not done so already, we urge you to get yourself up to date on the changes and what they mean for your business. There are specific steps that operators must take to remain in compliance with the Lien Law, so it is imperative you take urgent action to understand the changes.
If you attended October’s conference in Tarrytown, NY, you got to be part of the panel discussion where NYSSA’s two attorneys, Marc Kunkin and Joseph Miller, addressed the implications of the lien law amendment. If you were not able to attend the conference, we are hereby sharing the materials that were distributed to attendees. One link is a blue-lined copy of the Lien Law showing the exact changes that the amendment makes. The other link is a special guide that explains the changes and provides high level advice on how you as a self-storage operator may react to the changes (click on the links below). This “guide” document is meant as a helpful tool only, not as direct legal advice. NYSSA recommends that all operators consult with their attorney to fully understand the changes, the implications, the decisions that must be made, and the actions that must be taken.
The changes in this bill bring the Lien Law into the 21st Century, and they will improve communications between operators and occupants. The new bill is a step forward, and NYSSA endorses the progress it makes for our industry. We stand by to answer questions you may have as you adjust to the new law. Please do not hesitate to contact us, as we want to make the transition as smooth as possible for all operators and self-storage customers.
